Terms of Service

1. The service

CelebrateMeApp ("we", "us", "the App") lets people post celebrations and lets others ("Senders") send monetary gifts to the person being celebrated ("Recipient"). By creating an account or using the App you agree to these Terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to send or receive gifts. You agree to provide accurate information and to keep your account secure.

3. Payments and Stripe

All card payments, payouts, identity verification, and bank account handling are processed by Stripe, Inc. ("Stripe"). CelebrateMeApp never sees, stores, or transmits your full card number, CVC, bank account number, or government identification. When you check out, you enter that information directly into Stripe's PCI-compliant payment form, which is embedded into the App.

By using the gift feature you also agree to the Stripe Services Agreement and the Stripe Connected Account Agreement (Recipients only).

4. Fees

Each gift is charged to the Sender's card as: gift amount + a CelebrateMeApp platform fee + Stripe's processing fee. The Sender pays all fees on top of the gift amount, so the Recipient receives the full gift and CelebrateMeApp receives its full platform fee. Current fee schedule is shown at checkout.

5. Receiving payouts

Recipients must complete Stripe Connect onboarding (legal name, date of birth, address, tax info, and a bank account or debit card) before they can receive gifts. Senders cannot send a gift to a Recipient who has not completed onboarding. Payouts to your bank are scheduled and executed by Stripe; CelebrateMeApp does not hold your funds.

6. Refunds and chargebacks

Gifts are generally non-refundable. If a Sender disputes a charge or initiates a chargeback, Stripe may reverse the funds (including from the Recipient's connected account) and CelebrateMeApp may charge associated fees back to the Recipient.

7. Acceptable use

You may not use the App to: (a) send or solicit gifts in exchange for goods, services, or anything of value; (b) launder money or evade taxes; (c) harass, defraud, or impersonate any person; (d) post unlawful, hateful, sexually explicit, or infringing content; or (e) circumvent the App's fees. We may suspend or terminate accounts that violate these rules.

8. Tax

You are solely responsible for any tax owed on gifts you receive. Stripe may issue tax forms (such as a US 1099-K) where required by law.

9. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, and we are not a bank, money transmitter, or financial institution.

10. Limitation of liability

To the maximum extent permitted by law, CelebrateMeApp's total liability for any claim arising out of or relating to the App is limited to the greater of (a) the platform fees you paid to us in the 6 months before the claim, or (b) USD $50. We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Changes

We may update these Terms from time to time. Material changes will be posted in the App. Continued use after changes means you accept them.
